已領勞保老年給付再受僱 得僅參加職災保險

已領取勞保老年給付再受僱於勞保投保單位從事工作，或於政府登記有案的職業訓練機構接受訓練者，投保單位得為其辦理僅參加職業災害保險。該等被保險人於保險有效期間發生保險事故者，得依勞工保險條例規定請領職業災害保險相關給付。請領職業災害保險失能給付或死亡給付者，不須扣除已領取勞工保險老年給付。至於年逾65歲已領取公教人員保險養老給付、軍人保險退伍給付、老年農民福利津貼或國民年金保險老年年金給付者，如受僱於勞工保險投保單位從事工作或於政府登記有案之職業訓練機構接受訓練，投保單位亦得為其辦理參加職業災害保險，並自即日生效。
